Tell your job applicants: from 2 August 2026, the use of AI must be visible

The new transparency duty in the EU AI Act affects your hiring and communication, even if the strictest rules are still a while away.

From 2 August 2026, the transparency duty of the EU AI Act applies. If a candidate talks to a chatbot, that chatbot must make clear it is AI. If you publish text or images made with AI, that needs a note. The heavier rules for AI in hiring and CV selection have been delayed to late 2027 or August 2028. But the transparency rules already apply now. Fines can run up to 15 million euros or 3% of yearly turnover.

Put your use of AI in hiring on paper now

Make a short list this week: where in your hiring and communication does AI sit? Think of a chatbot on the job page, a writing aid for job adverts or an AI image with an advert. With a chatbot, it must be clear that candidates are talking to AI. AI text and images you publish need a note. The stricter rules for CV selection only arrive in 2027 or 2028, but start now. Make sure your team knows what AI does and where a person has the final word.

High-risk rules for recruitment delayed, but transparency already applies

The strictest rules of the AI Act for AI in hiring, such as CV selection, have been delayed to December 2027 or August 2028. The transparency rules do already apply from 2 August 2026. Anyone using AI in hiring must now be more open and let a person keep watch over decisions.
