Real estate agents edition
New AI rules are coming, and the tools in Funda and Office are getting smarter. Here's what really affects your work.
From 2 August: chatbots and AI images must be recognisable
The EU AI Act's transparency rules are coming in, and almost every estate agency falls under them.
On 2 August 2026, new rules from the EU AI Act take effect. Chatbots will then have to make clear that you're talking to AI. And AI-made images, including deepfakes, must be labelled as such. If you use ChatGPT, Copilot, or a similar tool at your office, the law counts you as a 'deployer'. These rules apply to you too. Fines can reach 35 million euros, or 7% of worldwide annual turnover.
Background for subscribersThis week, go through your listings. If there's a virtually furnished or enhanced photo, clearly state that it's an AI impression. And check right away: is nothing about the property itself made to look better than it is? Showing atmosphere is fine, making the property look better than it is isn't. This way, you're ready for 2 August, and you avoid a complaint about misleading information.
AI in recruitment is high-risk: human oversight required
The EU AI Act labels AI that selects or assesses people as high-risk. The enforcement deadline is 2 August 2026. Employers must ensure human oversight, check for bias (unfair prejudice), and inform people involved in advance.
